Privacy policy

Effective October 3, 2026

About this policy

L'Éclatant Corp. (“we”, “us”) operates L'Éclatant Cake Boutique & Café and this website. This policy explains what personal information we collect through the website, how we use and share it, how long we keep it, how we protect it, and the choices you have. We are based in Ontario, and we handle personal information in line with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), the federal law that governs private businesses in Ontario.

Consent

We ask for your consent when we collect personal information. When you send the custom order form, you consent to us collecting and using what you enter for the purposes described below. You can withdraw your consent at any time by contacting us, subject to legal or contractual limits; if you do, we may not be able to complete your order.

What we collect

Information you give us. When you request a custom cake quote, we collect what you enter in the form:

  • your name, email address and, if you give it, phone number
  • details of your order: date, occasion, size, flavour, number of guests and design notes, which may include dietary needs or allergies you tell us about
  • any inspiration photos you upload. Photos may show other people or other people's work; please only send photos you have the right to share, including permission from anyone pictured

Information collected automatically. Like most websites, our hosting provider automatically records basic technical information when you visit, such as your IP address, browser and device type, and the pages you request and when. On the custom order page, an automated check also reads technical signals from your browser to tell people from spam bots. We use this information only to keep the site secure and working.

How your quote request reaches us

When you send the form, your browser makes large photos smaller, and our website saves each photo again, which removes hidden details such as the location where it was taken (iPhone HEIC photos are passed on as they are, so their details stay). Your request and photos are then emailed to us and kept in our business email. The website itself does not store your request. Resend, which delivers the email, keeps a copy for a short time as part of its service.

How we use it

We use the information you send us only to:

  • reply to your request and prepare a design and quote
  • arrange and fulfil your order if you go ahead
  • refer back to past requests and orders, for example if you order again or have a question
  • keep records we are required to keep, such as for tax

We use automatically collected information only to operate, secure and troubleshoot the website. We won't send you marketing emails unless you ask us to, and we do not sell or rent personal information.

Who we share it with

Only our staff who need your information to prepare your quote or order can see it. We also use service providers that help us run the website and our email, who receive only what they need:

  • Vercel, which hosts this website and runs the anti-spam check on the custom order form
  • Resend, which delivers quote requests to our inbox
  • Google, which provides our business email (where quote requests and photos are kept) and the map on our home and Visit pages
  • Adobe, which serves the typeface used for our headings and may record that a page was viewed, for font licensing

These providers may store or process information outside Canada, including in the United States, where it may be accessible to authorities under local laws.

We may also disclose personal information:

  • if the law requires it, or in connection with legal proceedings
  • to protect our legal rights or the safety of others
  • to a buyer or successor if our business is sold or transferred, who must continue to protect it as described here

Links to other websites

Our website links to other sites, such as Instagram and Google Maps. We are not responsible for their content or privacy practices, and we encourage you to read their privacy policies.

Cookies and tracking

We do not use analytics or advertising trackers, and we do not track you across other websites. Because we don't track visitors, we don't respond differently to browser “Do Not Track” signals.

Our home and Visit pages show an embedded Google Map. When it loads, Google may set cookies and receive technical information such as your IP address, under Google's privacy policy. You can block these cookies in your browser settings without affecting the rest of the site. If we add other cookies or trackers, we will update this policy first.

How long we keep it

We keep quote requests, the photos sent with them, and order records in our business email. We don't delete them on a fixed schedule: we keep them so we can refer back to past orders, answer questions, and meet our tax and accounting obligations. You can ask us to delete your quote request or other information at any time (see below), unless the law requires us to keep it.

How we protect it

We use reasonable administrative, technical and physical safeguards to protect your information, including limiting access to staff who need it, and the website is served only over encrypted (HTTPS) connections. No method of sending or storing data is completely secure, so please don't include sensitive information such as payment details in the quote form.

Children

This website is not directed at children, and we do not knowingly collect personal information from anyone under 16 without a parent or guardian's consent. If we learn we have, we will delete it.

Access, correction and your choices

You can ask to see the personal information we hold about you, ask us to correct it, or ask us to delete it, subject to any legal requirement to keep it. Email info@leclatant.ca and we will respond within 30 days. We may need to confirm your identity first.

Changes to this policy

We may update this policy from time to time. When we do, we will post the new version here and change the effective date at the top. Significant changes will be highlighted on this page.
